Deposits Bonds - what are they and will they suit you?

A deposit bond is an alternative that can be used in place of a cash deposit.

A purchaser may not always have the cash necessary to be able to pay the deposit on a property, such as the 10% often sought in Victoria or New South Wales.  Rather than both the purchaser and seller missing out on a sale, the purchaser may choose to explore using a deposit bond.

What is a Deposit Bond?
A deposit bond is basically an insurance policy, but it is for the vendor's benefit only.  A deposit bond is a document that tells the vendor that the insurance company will pay the deposit to the vendor in any of the circumstances where the deposit would ordinarily be forfeited by the seller.  A deposit bond takes the place of a cash deposit required between the time of contract exchange and settlement of the property being purchased.

The purchaser takes out a deposit bond for the deposit amount required and is charged a fee based on the amount required and the length of time the deposit bond is required for.

Under the deposit bond, no money actually changes hands.  Instead, all purchase funds are paid at settlement.  Settlement takes place, the purchase price is paid in full and the deposit bond simply lapses.

However, if the purchaser defaults and the insurer is required to pay the vendor pursuant to the deposit bond, the insurer will then look to the purchaser for recovery of the amount paid.

Benefits of using a Deposit Bond
The benefits of using a deposit bond include:
  • a purchaser is using "other people's money", rather than their own
  • can avoid the need for bridging finance
  • can be used by for "off the plan" purchases
  • can be used to buy property at auction
  • some deposit bonds can be used for up to 4 years.

Issues with using a Deposit Bond
Some of the issues include:

  • will not suit or be accepted by all Vendors.  
    For example, where a vendor requires an early release of the deposit so as to be able to pay a cash deposit on another purchase
  • will not be accepted by all Real Estate Agents.  
    Real Estate Agents are sometimes paid their commission from the deposit.  As no money actually changes hands under the deposit bond, all purchase funds are paid at settlement which means the agent will need to wait for their commission
  • always seek the Vendor's agreeance to the use of a Deposit Bond first.  
    A purchaser can be trapped if the contract does not specifically state that the deposit can be paid by way of a deposit bond.  If the vendor insists upon a cash deposit being paid, the purchaser will be forced to incur additional costs: 
    • first for the wasted deposit bond fee, and 
    • second for the cost of producing the cash required

It is important to remember that the purchaser remains responsible for completion of the contract, including the payment of any costs and penalties associated with a default.

Question 1             
What has been your biggest challenge in business and how did you overcome it?

Making the decision to invest heavily in a website that did everything I wanted it to do, both in the short term and in the long term.  The challenge was to find the right developer and to educate myself sufficiently so that I knew what to ask for.

Question 2
If you had to start your business again from scratch, what would you do differently?

I would have set up my website earlier and I would have hired a PA earlier.

Question 3
Who do you admire and why?

My mother and father.  Why? Because they gave up so much to give my three brothers and I a strong foundation in life. They put aside their personal wants and needs to ensure they were there for their children. I admire that self sacrifice. And importantly, they never made a big deal out of it or expected us to be grateful to them for doing that. 

Question 4
It takes a lot of determination and dedication to succeed in business.  What keeps you motivated?

All I have to do is look at my young son and that's enough to motivate me. I created this business so I could choose when I worked and how I worked. 

So whenever I feel tired or a bit lazy and don't feel like working, all I have to do is visualize getting up every morning, slapping on the makeup and high heels, negotiating peak hour traffic and reporting to a boss I don't like or admire and that's enough to make me sit down at my desk and start working.  Works every time. 

Question 5
What are your 3 biggest success tips? 

  1. Hire a good copywriter. Without good copy, you could have the best business in the world, but no one will know about it and even if they do, they won't be sufficiently persuaded to try you out.

  2. Invest in a Search Engine Optimisation copywriter. You could have the best business in the world, have great copy but still not get found on Google.  Investing in an SEO Copywriter ensures you have great copy AND you get on the first few pages of Google.

  3. Spend money to make money.  If you want to expand your business and offerings, you have to spend money on creating new products, new promotional material, new web content, on networking, on hiring good people etc.  Take a long term view and know that everything you invest will (hopefully) reap bigger dividends.
