Local Law 158/2017: Restriction on Professionally Certified Filings

We have been notified by the NYC Department of Buildings that a new Local Law 158 of 2017 will go into affect on May 30, 2019.
 
This local law will restrict filings that are Professional Certified on buildings where the owner has an open Work Without a Permit Violation that was issued on or after August 28, 2018. These buildings will be flagged in BIS with the tag “LL158/17 Pro Cert Restriction” If there is an “until date” in the flag, applications for plan approval must be filed as a standard plan exam.
 
Please note: Standard Plan Exams will delay the permits being issued since the applications are now being reviewed by an Examiner at the NYC Department of Buildings.
 
The only exemption to this Local Law is that if the Work Without a Permit was on a part of the building that is not owned by the building owner, or the ownership has changed. The owner will be required to provide proof for the exemption.
 
If any jobs fall into this category, we will need to meet with the Project Advocate and present proof that an exception should be granted.  Depending on the type and complexity of the job and the time involved with additional meetings and/or plan examinations there will be additional professional fees.
