Why all this? Recently, a New York State Appeals court ruled that a vacation home is not a permanent place of abode for tax purposes. Because of this, a taxpayer who actually spent the required minimum of 183 days working in New York lost the bid to file their individual
taxes as a New York resident.
This was in the recent judgment passed on June 30, 2022, on the case Matter of Nelson Obus v. New York State Tax Appeals Tribunal. You can read the entire decision HERE.
This judgment has raised some eyebrows because it will make such determinations confusing in the future. What’s also scary is that this was an overturn of the decision that had been granted in favor of the taxpayer in question by a lower court.
There are some blurred lines in this case. And, if such lines could be used to overturn a lower court decision, it means going forward, all your tax matters should be handled carefully, by a trained professional.
