Is Punxsutawney Phil guilty of false advertising? On February 2, 2024, our favorite furry rodent here in Pennsylvania predicted an early Spring. But, it's
definitely still Winter just based on the view outside my front door this morning! So I wondered, what is Phil's track record? How often does he accurately predict what the six weeks following February 2 will bring? Sadly, according to my internet research, he's only correct about 30-39% of the time. With that track record, would
you hire him to predict the weather???? Would you place much stock in his forecast? Would you make plans for outdoor activities based on his prediction? Which of course made me think about the people we hire to help us run our businesses. Whether you are hiring an attorney, business coach, social media manager, virtual assistant,
web designer or some other role, do you ask them questions about their qualifications to do the job you are hiring them for? Do you ask them about their track record for customer satisfaction? How about their track record for successful outcomes? Do you ask for referrals? When a coach claims you can 10x your income, do you ask how many of their clients actually make that benchmark? While not all of these questions will be relevant for every role, doing your homework to learn more about the person you are planning to hire will help you avoid costly mis-steps. I was recently asked by a potential client about my track record for successful trademark filings.
Given that I've been actively practicing trademark law since December of 2020 and it takes an average of 18 months for an application to reach final disposition, only about half of the marks I have filed have reached that stage. Of the marks that have reached final disposition, I have an 89% overall success rate. For
applications where I did the initial filing, my success rate is 94%! I'm proud of that success rate! More importantly, I can easily explain the two marks that didn't make it to registration. I've been very busy behind the scenes writing the second edition of Smooth Sailing: A Practical Guide to Legally Protecting Your Business. The second edition is revised and expanded (as in double the amount of
material). In fact, it's really a whole new book! It has gone from a "practical" guide to "an ESSENTIAL" guide for small business owners and I can't wait to get it out to the world. For the month of February my chosen charity is the Bucks County SPCA. Bucks County SPCA is a 501(c)(3) organization that assists animals in need and prevents suffering through rescue, rehoming, cruelty investigation and prosecution, and community outreach.
